Terms and conditions

1. OVERVIEW

These terms and conditions (“Terms”) apply to every order you place with David Calvert Photography (“we”, “us”, “our”). By placing an order through our website or in person, you agree to be bound by them.

2. Agreement Between You and Us

These Terms, together with our Privacy Policy and any documents referred to in them, form the entire agreement between you and us about your purchase.

Please read these Terms carefully before ordering.

3. PLACING AN ORDER

When you place an order, you make an offer to purchase the products you have selected. The contract is accepted and formed only when we confirm your order by email.

No orders will be processed until payment has been received in full.

4. PRODUCTS

All sizes quoted by us are approximate and due to the bespoke nature of the Artwork Products, may not be compatible with standard print sizes and pre-made frames etc.

Colour Reproduction and Print Finish

We take care to ensure that the images on our website represent our artwork as accurately as possible. However, their colours, brightness and contrast may appear differently on screens due to variations in devices and display settings.

Our fine art and photographic prints are produced using professional processes, including the use of archival inks and carefully selected papers. The texture, surface and natural tone of these papers may affect how colours and tones appear compared to what you see on screen. Because of this, we cannot guarantee an exact colour, brightness and contrast match between your screen and the finished print. Variations such as these are normal and are not considered faults.

5. RETURNS AND REFUNDS

Orders placed online, by phone, or by mail.

Under distance selling regulations, you have the right to cancel your order within 14 days of receiving your goods and receive a full refund.

To cancel:

Notify us by email or phone within 14 days of receiving your order.

Return the goods to us within a further 14 days.

You are responsible for all return postage costs. In order that we can refund you, the item must be returned and received in as new and unused condition.

We will refund you within 14 days of receiving the returned goods, using the same payment method you used for the order, unless we agree otherwise.

Exceptions:

This right does not apply to personalised or bespoke-made items unless the item is faulty. A bespoke item is a custom-made piece tailored specifically to your preferences, including size, appearance, finish, and presentation.

Damage caused during return shipping may affect your refund if the goods are not
returned in their original condition.

If an incorrect price or product information is displayed on our website, we may contact you to correct the order. If we cannot correct the error, we may cancel the order and issue a full refund.

Orders placed In person

If you purchase goods directly from us in person, the distance selling cancellation rights do not apply. However, if the goods are faulty or not as described, you still have legal rights under the Consumer Rights Act 2015.

Digital downloads

For all products sold in a digital format, no refunds or exchanges are given.

6. DELIVERY

7. LIABILITY

We are responsible for foreseeable loss or damage caused by us.

We will not be liable to you for:

(a) your loss of profit, expenses, loss of anticipated savings, loss of revenue or earnings, or loss of business (in each case, whether direct or indirect); or

(b) any indirect or consequential loss.

Events Outside Our Control

If we are prevented or delayed from supplying your Artwork Products by an event outside our control including, but not limited to: delivery delays in transit, illness, government directive, acts or god, fault or failure of equipment, software, hardware, networks or infrastructure or failure by third parties, then we will contact you as soon as possible to let you know, and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for failure or delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and
receive a refund for any goods or services you have paid for but not received.

Nothing in these Terms affects your statutory rights as a consumer.

8. INTELLECTUAL PROPERTY RIGHTS (COPYRIGHT)

Under the Copyright, Designs and Patents Act 1988, we own the copyright on the Photographs we take and sell. No right, title, licence or interest in the Photographs or any copyright therein is granted to you.

If you purchase Artwork Products, you will own the Artwork Product, that being the medium on which a Photograph is printed, once you have paid for it in full. Copying of any part, scanning or other reproduction of an Artwork Product is an infringement of our rights and is strictly forbidden by law.

Without our prior consent, you undertake not to (a) use or allow any Artwork Product that are provided to you for any commercial purpose, and any such use may be subject to additional charges, or (b) crop, resize, edit, manipulate or otherwise alter any Artwork Product provided to you.

You are not permitted to use, upload, or submit any Artwork Products or Digital Images for the purpose of training, developing, or refining artificial intelligence systems or machine learning models without prior written permission. All images remain the copyright of David Calvert, and any unauthorised use of images in AI systems will be treated as a breach of copyright.

9. ERRORS OR OMISSIONS

We take care to ensure that all information on our website, including prices, product descriptions and images, is accurate.

Occasionally, mistakes may occur. If we discover an error in pricing or product details after you place an order, we will contact you as soon as possible.

We may:

Offer to correct the error and provide you with the correct product at the correct price; or cancel your order and issue a full refund if the error cannot be corrected.

We are not responsible for minor typographical errors, technical glitches, or small variations in product appearance that do not materially affect the product.
